WARREN: Woman shot

A Warren County man is in custody following a shooting incident Tuesday night.

According to the Warren County Sheriff's Office, Michael Leroy Fisher was still in custody Wednesday afternoon as Conewango Township police continue investigating an incident which occurred at an apartment at 113 Jackson Run Road.

According to criminal complaint documents obtained through District Judge Glenn Carlson's office, Conewango Township Police Officer Scott Neiswonger was dispatched to the apartment building at approximately 9:50 p.m. in response to reports that a female victim had been shot.

According to Neiswonger's affidavit of probable cause, upon arriving at the scene, he found Fisher in the living room of the first-floor apartment and "heard a female moaning in pain."

Neiswonger reported holding Fisher at gunpoint and asking, "Where is the shooter?" to which Fisher raised his hand and replied, "That would be me."

Upon entering the kitchen, Neiswonger said he saw Toby Janean Weiss sitting on a stool holding a towel to her stomach. According to Neiswonger, Weiss "was bleeding from her stomach area and a pool of blood was located on the floor."

According to the affidavit, Neiswonger placed Fisher in custody while awaiting the arrival of emergency medical responders.

According to the affidavit, Neiswonger asked Weiss, "Where was the gun that the male shot her with?"

Weiss replied that she believed it to be a handgun laying on the kitchen table. Neiswonger described the weapon as being, "black and brown in color."

Neiswonger said he disengaged the magazine and cleared a round from the weapon's chamber at that time.

According to the affidavit, Fisher said he "shot his girlfriend on accident while he had been cleaning his gun."

Upon further questioning at the police station, the affidavit said, Fisher "confessed to shooting his girlfriend, Toby Weiss, while she had been located on the couch inside the residence. Fisher advised that he was holding the gun and dropped the magazine from the weapon. Fisher stated that he did not believe that the gun would fire without the magazine. While Fisher was holding the gun, he pulled the trigger and accidentally shot Weiss in the stomach."

Fisher was arraigned before Carlson on charges of aggravated assault, recklessly endangering another person and (attempt) involuntary manslaughter at approximately 3:30 a.m. Wednesday. The charges were filed through District Justice Laura Bauer's office.

According to Conewango Township Police Chief Jason Peters, an investigation into the incident is continuing.

Weiss was transported to UPMC Hamot in Erie for treatment. A nursing supervisor at Hamot said Weiss was in serious condition Wednesday afternoon.
